Federal Appeals Court Upholds Constitutionality of Individual Mandate

On June 29, 2011, the U.S. Court of Appeals for the 6th Circuit ruled that the individual mandate in the Patient Protection and Affordable Care Act (PPACA) is constitutional. This ruling affirms an October 2010 U.S. District Court decision.
Two other U.S. Courts of Appeal (4th and 11th Circuits) have also heard arguments on appeal of District Court decisions on the constitutionality of the individual mandate and their rulings are expected soon.
We anticipate that the issue will ultimately be decided by the Supreme Court. This week’s ruling moves the process one step closer to Supreme Court review.
