Legislative Update

On July 19, a federal district court judge struck down Maryland’s Fair share legislation (S.B. 1284) that would have forced Wal-Mart and other large employers to spend a certain amount of their payroll on health care for their employees. Judge Frederick Motz said that the “Wal-Mart Bill”, enacted by the General Assembly overriding Governor Robert Ehrlich’s veto earlier this year, violated ERISA’s fundamental purpose of “permitting multi-state employers to maintain nationwide health and welfare plans, providing uniform nationwide benefits and permitting uniform national administration” and was therefore preempted.
