Legislative Update

Kansas’ 2006 veto session ended on May 10 and the legislature held their sine die ceremony on May 25.   Among the bills signed Governor Kathleen Sebelius (D) was S.B. 522 which provides an insured with certain appeal rights regarding adverse health care decisions made through a utilization review process. If a health insurance plan includes a provision for two levels of internal review of a health care decision which is adverse to the insured person, the insured person would have the ability either to appeal an adverse decision or waive the right to an appeal. The bill also provides for representation during the hearings and the ability to record the appeal process. The following bills failed to pass during the session: 1) H.B. 2579/S.B. 557 (Fair Share Health Care Fund Act (Play or Pay) requiring for-profit and non-profit companies with more than 10,000 employees to spend at least 8 percent and 6 percent of their payrolls, respectively, to the Kansas Secretary of Labor, in lieu of providing a comparable level of health care to employees; 2) H.B. 2675, establishing a pilot program to provide health insurance through the state employees’ health benefits program; and 3) H.B. 2789, authorizing any health insurance policy issued to a Kansas resident to have a subrogation and lien clause. The clause would allow the insurer to recover its policy benefits paid by the tortfeasor to the insured party.

Frank Monahan, General Manager
Frank Monahan is the general manager of CIGNA HealthCare’s operations in Kansas and Missouri and is based in St. Louis. Monahan is a seasoned executive with 15 years of sales and marketing experience in the health care industry. Monahan is responsible for new sales and account management in the Kansas and Missouri markets and oversees a sales team of more than 30 professionals. He is also responsible for fostering and deepening relationships with employers, providers, brokers and consultants in the state.

A Pennsylvania native, Monahan earned his bachelor’s degree from LaSalle University in Philadelphia. Monahan most recently served as vice president and general manager of large group sales for Premera Corporation. Prior to joining Premera Corporation, Monahan was vice president of sales, marketing and field operations for Capital Blue Cross. In addition, he held various sales and marketing positions at Aetna.
