Important notice to CIGNA Life Insurance Company of New York Insureds and Claimants Concerning Pre-Existing Conditions
This notice applies to you if your disability claim under a CIGNA Life Insurance Company of New York policy was denied due to a pre-existing condition on or after June 27, 2004.
On June 27, 2007, the New York Court of Appeals, in Benesowitz v. Metropolitan Life Insurance Company, ruled that Section 3234 of the New York Insurance Law require insurers to make benefit payments on disability policies that resulted from a pre-existing condition after an insured person has been covered for no more than 12 months - even if the disability began during the first 12 months of coverage. In response to this decision, CIGNA Life Insurance Company of New York will be reviewing all disability claims which were denied due to a pre-existing condition on or after June 27, 2004, to determine whether benefits are payable. If this applies to you, you should expect to be contacted no later than February 29, 2008. If you wish for your claim to be further evaluated, you will need to provide authorization to obtain appropriate information needed for your claim to be considered. Your claim will continue to be subject to all other terms of the policy under which your claim was incurred.
